Intellectual Property Law Amendments 2025: AI, Data and New Boundaries of Intellectual Property Protection

Vietnam’s 2025 amendments to the Intellectual Property Law (“IP Law 2025”), effective from 1 April 2026, represent the first comprehensive legal response to issues arising from artificial intelligence, data and digital platforms. These changes redefine legal responsibility in the digital economy, rather than merely introducing technical adjustments.

AI is not an IP rights holder

The IP Law 2025 clarifies that AI cannot be recognised as an IP rights holder. Works or inventions autonomously generated by AI, without meaningful human creative contribution, are not eligible for protection. Where AI is used as a supporting tool and human creativity plays a decisive role, IP protection may still be granted.

Training data: no longer a grey area

The law establishes clear conditions under which protected data may be used for AI training without constituting infringement, placing greater responsibility on businesses to assess legal risks associated with input data.

Digital platforms and liability

Platform operators are now subject to clearer IP obligations, with courts empowered to order the removal or blocking of infringing online content.
